CLASS 7, THE WAR RISKS CLASS ____________________ NOTICE IS HEREBY GIVEN that a SEPARATE MEETING of the MEMBERS OF CLASS 7, THE WAR RISKS CLASS, of The London Steam-Ship Owners’ Mutual Insurance Association Ltd (“the Association”) will be held at the REGISTERED OFFICE of the Association, 50 LEMAN STREET, LONDON, E1 8HQ and/or via the Zoom video conferencing platform at 11.30am on WEDNESDAY, 27 th JANUARY 2021, or as soon thereafter as the meeting of the Members’ Committee called for that day is finished, for the purpose of amending the Rules*. The following amendments together with such further amendments, if any, as may be proposed at the Meeting, will be submitted for adoption with or without modification and with effect from noon G.M.T. on the 20th day of February 2021. The explanatory notes in italics will not appear in the actual Rules.] 4.D.7 Exclusion of Computer Virus Exclusion The Association shall not be liable for any losses, liabilities, costs or expenses directly or indirectly caused by or contributed to by or arising from the use or operation, as a means for inflicting harm, of any computer virus. PROVIDED ALWAYS that: 4.D.7.1 Rule 4.D.7 shall not operate to exclude losses (which would otherwise be covered under Rule 2, parts B, C, D, E and F, Rule 3 and Rule 4.A.2) arising from the use of any computer, computer system or computer software programme or any other electronic system in the launch and/or guidance system and/or firing mechanism of any weapon or missile. 4.D.7.2 To the extent not excluded by this Rule 4.D.7 any loss otherwise covered by this Class of the Association will not be prejudiced by the involvement of the use or operation of any computer, computer system, computer software programme or any other electronic system. [Explanation: the change is being made by the members of the Combined Group of War Risk Associations (CGWRA) in order to conform with re-insurance requirements.] - 2 4.D.9 Corona Virus Exclusion The Association shall not be liable for: 4.D.9.1 any loss, damage, liability, cost, or expense directly arising from the transmission or alleged transmission of: a) Coronavirus disease (COVID-19); b) Severe Acute Respiratory Syndrome Coronavirus 2 (SARS-CoV-2); or c) any mutation or variation of SARS-CoV-2; or from any fear or threat of a), b) or c) above; 4.D.9.2 any liability, cost or expense to identify, clean up, detoxify, remove, monitor, or test for a), b) or c) above; 4.D..9.3 any liability for or loss, cost or expense arising out of any loss of revenue, loss of hire, business interruption, loss of market, delay or any indirect financial loss, howsoever described, as a result of any of a), b) or c) above or the fear or the threat thereof.
