BIMCO CII Operations Clause for Time Charter Parties 2022 Publications Jeff Cox Published: November 24, 2022 Contact author Download article pdf Overview On the 17 November BIMCO published a Carbon Intensity Indicator (CII) clause drafted in response to the new CII regulations from the International Maritime Organization (IMO).  The purpose of the clause is to assist owners and charterers in formalising operational measures in relation to the IMO’s CII regime which will come into effect from 1 January 2023.   The focus is on improving transport efficiency measured in terms of carbon emissions per deadweight ton-mile. Since CII is an operational measure, achieving a more favourable rating requires changes as to how the vessel is used. The clause is premised on time charterers being primarily responsible for a ship’s emissions since they are the party in charge of making decisions as to how the ship is operated.  It includes provisions by which owners and charterers agree to collaborate and cooperate on the collection and sharing of data and for co-operation on voyage planning with a view to achieving compliance with the ship’s agreed CII rating. Owners retain responsibility for a number of obligations in relation to CII compliance to minimise fuel consumption, maintenance and passage planning as well as the monitoring and calculation of fuel consumption data. The clause is intended for use in short as well as long-term time charters.  When entering into a charter party, or incorporating the clause into an existing charter party, the parties are to agree on a specific CII value to be achieved by the ship each year.  It has been acknowledged that the length of sea voyages and the duration of waiting time are key factors affecting a vessel’s CII rating independent of a vessel’s design or operational efficiency Decarbonisation - Charterparty and Bills Lading Issues .  Whilst owners and charterers have different roles under the CII Operations
