To all Members of Class 3 Protection and Indemnity NOTICE IS HEREBY GIVEN that a Separate General Meeting of the Members of Class 3 – Protection and Indemnity, of The Britannia Steam Ship Insurance Association Limited (“Britannia”) will be held at Regis House, 45 King William Street, London EC4R 9AN on Tuesday, 9 January 2024 at 09.30 GMT for the purpose of considering and, if thought fit, passing the following ORDINARY RESOLUTION: "That, the Rules of Class 3, Protection and Indemnity of Britannia (the “Class 3 Rules”), be amended with effect from noon GMT on 20 February 2024 as set out in the Annexure” . A Member of Class 3 – Protection and Indemnity entitled to attend and vote may appoint a proxy to attend and vote in their stead. Such proxy must be a Member of the Association or the duly authorised representative of a body corporate which is a Member. 2. A Member may attend the meeting via Zoom, access details to which can be obtained from dkhandelwal@tindallriley.com Annexure – Class 3 (P&I) Rule Changes for the 2024/25 Policy Year _________________________________________________________ 12/23 The Class 3 (P&I) Rule Changes are outlined below. 1. Except for one minor revision detailed under 2. below, the revisions to the Rules arise from a general Review aimed at modernising and re-numbering the text. Therefore, there is no change to the scope of cover and there are no material changes in the Rules except to ensure alignment with the Pooling Agreement. The main objectives behind the Review were to: a. introduce a Rule dealing with Consortium risks; b. modernise the Rule relating to ‘Charterers’ P&I’ risks; c. introduce a hierarchical numbering system for the Rules to aid cross-referencing and greater online accessibility; and d. modernise the language of the Rules, including removing gender-specific terms (e.g. amending “seaman” to “seafarer”). A clean version of the P&I Rules for 2024/25, and a version showing the amendments that have been made to the existing 2023/24 Rules, may be found below: P&I Rules: 2024/25 - clean P&I Rules: 2024/25 – track changed version 2. From 20 February 2024, poolable cover will be excluded in respect of non-marine personnel employed by a party other than the Member, regardless of where the accident or injury occurred, unless there has been a contractual allocation of risk on Knock for Knock terms which has been approved by the Association. The terms of poolable cover will therefore exclude liabilities for personal injury or death of any non-marine personnel if an incident occurred on board the facility on which they were employed to work, as well as an incident on board that Member’s ship. This has necessitated a change to P&I Rule 19(4)(iii)(b), which is Rule 19.4.3.2 under the proposed new numbering system.
