Small Tanker Oil Pollution Indemnification Agreement 2006(STOPIA 2006) & Tanker Oil Pollution Indemnification Agreement(TOPIA) (2) 11 May 2006 No.06-002 We refer to our previous circular No.05-013 of 7 February 2006 entitled "Small Tanker Oil Pollution Indemnification Agreement 2006(STOPIA 2006) & Tanker Oil Pollution Indemnification Agreement (TOPIA)". In that circular we reported that STOPIA 2006 and TOPIA will take effect from 20 February 2006, subject to the consent of the IOPC Fund at their next Assembly. The IOPC Fund, at their February 2006 Assembly, consented to both Agreements which have become effective, as scheduled, from 20th February. The implementation of STOPIA 2006 means that the previous STOPIA agreement will terminate on 2 June 2006, pursuant to a notice given to the IOPC Fund on 2 March 2006. Members may also recall that our previous circular advised certain key states, who supported using shipowners' revised to halt revision, requested that the benefits of STOPIA be extend to all states who are party to CLC 92. The IOPC Fund Assembly considered the issue but concluded it undesirable to extend STOPIA 2006 to CLC 92 states who were not also parties of Fund 92. Accordingly STOPIA 2006 will not extend to non-Fund 92 states.
