Loss Prevention 28 Jul, 2025 Brazil Updates Ship Biofouling Standards to Align with IMO Guidelines Marcus Winchester Loss Prevention Officer According to a recently released circular shared by Proinde Brazil, the Brazilian Navy has updated its ship biofouling regulations to align with the 2023 IMO Biofouling Guidelines. The new standards, implemented through NORMAM 401/DPC, aim to minimize the transfer of non-native aquatic species along the Brazilian coast.  Download PDF All ships over 24m operating in Brazilian waters must maintain a Biofouling Management Plan and Biofouling Record Book. Vessels navigating between Brazil’s three distinct biogeographic regions must maintain a biofouling rating of 1 or lower (no fouling or microfouling only). Ships with ratings of 2 or higher indicating macrofouling must undergo cleaning before transit. Vessels requiring cleaning must obtain prior approval from local maritime authorities, preferably 10 days in advance. Cleaning operations must capture waste materials and are prohibited in ecologically sensitive areas without the express permission of the environmental authority. While permit requirements took effect on June 17 th , 2025, full enforcement with penalties is set to take effect on February 1 st , 2026. Significant fines may be imposed for environmental harm, with substantially higher penalties for serious violations that affect human health or biodiversity. The grace period allows ship operators to adapt procedures and implement compliant biofouling management systems before penalties commence. The Circular can be viewed here .
