Court reduced disability grading;upholds POEA contract provisions 27 October 2005 No.525 We have been provided by our Manila correspondents, Del Rosario & Del Rosario, with information about a recent ruling of the Court of Appeals in relation to a crew injury case. In this case, the seafarer was injured on board and eventually given by the company-designated physician a disability Grade 10. He claimed for Grade 1 disability benefits. The NLRC awarded Grade 1 disability benefits as claimed, but the Court of Appeals reversed the ruling of the NLRC and awarded Grade 10 disability benefits on the ground that the terms of the POEA contract must be respected.
