Members need to be aware of proposed increased liability limits to OPA-90. The Proposals The Bureau of Ocean Energy Management, BOEM, has released an update on proposed adjustments to the limit of liability for offshore facilities that cause oil spills. Full details of the news bulletin from BOEM can be found attached. A key change would see limits increased from USD75 million to approximately USD134 million. This would apply to offshore facilities in federal and state waters under the Oil Pollution Act 1990. Advice For Members who may be affected by these developments, they may wish to note that there is an opportunity to provide feeback to BOEM.
